TERMS AND AGREEMENT

OVERVIEW

This website is operated by Göttingen Writers Guild. These terms and conditions apply while engaging in any services or information available on the website. This page contains the most up-to-date version of the terms and conditions, and it is subject to change.

SECTION 1: ALL ANTHOLOGY SUBMISSIONS

Göttingen Writers Guild is a student-run organization sponsored and funded by AKB Stiftung creativity and studies program in Georg-August-Universität Göttingen. The terms and conditions on this page apply to all submissions.

The author of the work submitted to this anthology will have read and understood all the terms and agreement before execution of publication for their submission.

We reserve the right to refuse a service (i.e. publication) to anyone at any time. If any writing, imagery, and/or illustration is accepted, its author is responsible for ensuring that it is not plagiarized and that they have the proper permissions from any previous publications to submit it. We may re-publish any writing at our discretion if we choose it for publication.

All published work will appear exactly as they appeared in the submission unless otherwise noted. Minor grammatical mistakes will be corrected automatically, and some complex formatting that cannot be reproduced on the website may undergo a small change. If there is any confusion about how grammar or structure changes might alter the meaning of the writing, the author will be contacted.

Any person who wishes to submit their work is under the age of 18 must make their minor status known to an editor and present a signature from his or her guardian consenting to the publication of their work.

SECTION 2: AGREEMENT TO PUBLICATION

Once any work is accepted by the editor, the author grants, assigns, and licenses Göttingen Writers Guild a non-exclusive, royalty-free, perpetual, worldwide license and right to use, display, reproduce, distribute, and publish the accepted work on the internet and on or in any medium (i.e. print and digital). After publication the rights revert back to the original author.

This use of the work entitles Göttingen Writers Guild global anthology rights, both in the English and German language as well as in translation anywhere in the world, and in clothbound, paperback, book club, reprint, and Braille editions of the anthology. It is also understood and agreed that the Göttingen Writers Guild may use this Work only in the above-mentioned anthology and reprintings of it, and that the author shall retain all other rights to the work not specified here.

The author grants permission for transcription of their work in this anthology to be translated into Braille, tape, talking, or oversized type book, only in the case that the Work or anthology is selected for such transcription by a nonprofit organization for the handicapped.

SECTION 3: PAYMENT AND PROMOTION

At this time Göttingen Writers Guild relies entirely on donations and funding from the university and students, so we cannot pay any author for their work they submit to this anthology. This applies to any future projects with Göttingen Writers Guild.

By contributing to the anthology, the submitter agrees to let us use their name, accepted poetry, and biography (if applicable) within the anthology and on resources to promote or describe the anthology.

SECTION 4: COPYRIGHT

Göttingen Writers Guild gives you complete ownership of your work. We are entitled to first serial and reprint rights. That is, we are allowed to be the first publisher of your work before the rights revert back to you, and we are then allowed to republish your work if it is chosen for an award or an anthology. These publication rights extend to all formats (digital and print) and locations, and once your work is accepted for an anthology you agree that it can be featured in our digital and print issues, which are distributed by Göttingen Writers Guild and its sponsor. The author who submits their work to this anthology: retains the sole, individual copyright on his or her contribution, and the publisher owns only the “collective work” copyright (if any) which attaches to the anthology as a whole.

SECTION 5: WARRANTIES AND INDEMNITIES

The author represents and warrants that he/she is the sole author(s) of the Work, {that the Work is original}, and that no one has reserved the rights granted in this agreement. The author also represents, to the best of his/her knowledge, that the work submitted does not contain any libelous material, and is not in violation of any rights of privacy or any other rights of third persons, and does not violate any existing common law or statutory copyrights, and has not been published before in any form.

The author agrees to hold the harmless against Göttingen Writers Guild any judgement finally sustained that the Work contains libel, plagiarism and/or invasion of privacy.

SECTION 6: NO COMPETING PUBLICATION

The Author agrees not to publish or permit others to publish this Work in any form prior to its publication and appearance in the above-named anthology, nor until six months after the appearance of the anthology.

SECTION 7: AUTHOR’S COPY

Göttingen Writers Guild agrees to provide the author with one complimentary copy of the original edition of the anthology upon publication, and to the best of his ability, to provide copies of other editions that may be published in Europe, and to inform author or any other editions which are planned or may appear.

SECTION 8: CHANGES IN TEXT OR TITLE

Göttingen Writers Guild agrees to make reasonable efforts to notify the author in advance of any editorial changes in title and/or text of the work, and to secure the author’s approval for any such changes whenever possible. Author agrees that such approval will not be unreasonably withheld. Göttingen Writers Guild will furnish the Author with galley proof or page proof of the work. Author agrees to return such proof with corrections in not more than thirty (30) days from receipt thereof.

SECTION 9: REVERSION OF RIGHTS

In the event that the above-mentioned anthology has not been published within 24 months of submission of their work as indicated by this agreement, rights revert to the author, and the author has the right to sell or arrange for publication of the above-named work in any manner, with the reservation that Göttingen Writers Guild will have the non-exclusive, one-time right to include the author´s work in an anthology of stories about {the theme and/or principal content of this anthology} at any time in the future without paying any additional monies to the author under this agreement, and without prejudice to all other rights of the author in this agreement. Author is expected to make no repayment of advances if for any reason–publication delays or otherwise–rights under this agreement have reverted to the author.

SECTION 10: VENUE

This agreement shall be deemed executed under the laws of the state of Lower Saxony. The laws abiding the city of Göttingen, Germany shall be the applicable law of this agreement.
